Statement by the Movement of Afghanistan Women in Exile on the Taliban's Penal Code

The Movement of Afghanistan Women in Exile has issued a statement expressing its profound concern over the Penal Code of the Islamic Emirate, describing it as a legal framework that raises serious concerns regarding the protection of fundamental human rights, equality before the law, and the administration of justice in Afghanistan. According to the statement, several provisions of the Penal Code appear to be inconsistent with internationally recognized principles of due process and fair trial. These include restrictions on the right to legal representation and access to legal counsel, the authorization of corporal and multiple punishments, and provisions that may result in discriminatory treatment, particularly with respect to women and girls. The Movement notes that these provisions also represent a significant departure from Afghanistan's previous legal framework and from internationally accepted standards of justice and the rule of law.
